Submissions

Stomp and Play LLC is always interested in hearing from you regarding our business products and services. Although we welcome your comments, Stomp and Play LLC does not accept or consider unsolicited creative ideas, suggestions, submissions, or materials that are sent to us in any format and by any means of transmission (including email), other than those that we have specifically requested. Any such material will either be sent back to you or discarded.

We hope you will understand that it is the intent of this policy to avoid the possibility of future misunderstandings when projects developed by Stomp and Play LLC might seem to others to be similar to their own creative work. It has been our experience that while you may believe that a submission or idea is unique, in many cases, such submission or idea resembles other submissions or ideas that Stomp and Play LLC has received, whether solicited or unsolicited, or are similar to projects that are being created by or on behalf of Stomp and Play LLC. While we do value your feedback on our business products and services we request that you be specific in your comments on those products and services. Therefore, please do not send unsolicited submissions of any kind to Stomp and Play LLC, including, without limitation, any unsolicited creative suggestions, stories or ideas, concepts, notes, formats, artwork, or other similarly-related materials.

Please note that if, despite our request, you send to us or transmit via email or through the Website unsolicited creative suggestions, stories or ideas, concepts, notes, formats, artwork, or other similarly-related materials (collectively, the “Submissions”), such Submissions are and will be treated as non-confidential and non-proprietary and Stomp and Play LLC will not be liable for any use or disclosure. Without limitation of the foregoing, to the extent it has the legal right, Stomp and Play LLC shall exclusively own all now-known or hereafter existing rights to the Submissions of every kind and nature and shall be entitled to unrestricted use of the Submissions for any purpose whatsoever, commercial or otherwise, without compensation to the provider of the Submissions or any other person or entity. In addition, you warrant that all so-called “moral rights” in those materials have been waived.

From time to time, areas on the Website may expressly request submissions of concepts, stories, or other potential content from you (“Invited Submissions”). Where this is the case, please carefully read any specific rules or other terms and conditions which appear elsewhere on the Website to govern those submissions (“Additional Terms”), since they will affect your legal rights. If no Additional Terms govern those submissions, then these Terms of Use will apply in full to any Invited Submissions you make.

It is our policy to respect the privacy of all guests. Therefore, in addition to the privacy of Registration data (see our Privacy Policy and Rules), we will not monitor, edit, or disclose the contents of a guest’s e-mail unless required in the course of normal maintenance of the Website and their systems or unless required to do so by law or in the good-faith belief that such action is necessary to: (1) comply with the law or comply with legal process served on Stomp and Play LLC; (2) protect and defend the rights or property of Stomp and Play LLC; or (3) act in an emergency to protect the personal safety of our guests or the public. Liability Waiver

Liability and Idemnification

1. Acknowledgment and Assumption of Risk

I understand that Stomp and Play LLC is an active play environment that includes running, jumping, sliding, climbing, art activities, interactive objects, and group play. I acknowledge these activities involve inherent risks for adults and children alike, including but not limited to falls, collisions, scrapes, bruises, strains, and other injuries. I knowingly and voluntarily assume all such risks on behalf of myself and (if applicable) any child (references can be singular or plural) under my care and agree to not bring any such action for those risks against Stomp and Play LLC to the extent allowed under the law.

2. Release and Waiver of Liability

On behalf of myself, my heirs, executors, and anyone else who may claim through me, and on behalf of any child (as applicable) under my care, I release and forever discharge Stomp and Play LLC, its owners, officers, employees, agents, and volunteers from any and all claims arising out of our participation, including those arising from negligence to the fullest extent permitted under Texas law.

3. Indemnification

I agree to indemnify, defend and hold harmless (to the maximum extent available under the law) Stomp and Play LLC its owners, officers, employees, agents and volunteers from any loss, liability, damage, cost or expense, including reasonable attorney's fees, arising from me and any child’s (that is under my care) participation to the fullest extent permitted by law, including claims arising from the negligence of Stomp and Play LLC.

Authorization and Authority

4. Emergency Medical Authorization

In the event of an emergency, I authorize Stomp and Play LLC staff to obtain emergency medical treatment for the child under my care if I am unable to consent and I accept responsibility for that treatment. I have entered my Emergency Contact details in the Stomp and Play LLC system.

5. Adult Participation

I will supervise each child under my care (as applicable) as Stomp and Play's rules require, including the correct use to the equipment that each child may use. I will follow posted rules and staff instructions, and use equipment only as intended and within any posted age or size limits. I will not take part in any activity that a medical condition, pregnancy or injury of mine makes unsafe for me.

6. Duration and Governing Law

This waiver is valid for twelve months from the date signed and is governed by the laws of the State of Texas.

7. Authority to Sign

I affirm that I am the parent, legal guardian, or authorized person of the child listed and have express authority to sign and understand that by signing this I am giving up certain legal rights for myself and each child (as applicable) under my care and am signing voluntarily.

Membership Contract

Your Membership

This membership agreement is entered into between you (“member,” “you,” or “your”) and Stomp and Play LLC (“we,” “us,” or “our”). By enrolling in a membership, you agree to the terms below. The agreement constitutes the entire agreement between the parties.

Membership provides access to our facility and services based on the plan selected at enrollment. Membership does not replace the requirement to sign a separate liability waiver, which must be completed prior to participation.

Membership plans and benefits

We offer multiple membership tiers designed to provide varying levels of access to open play, classes, events, and other member benefits.

The specific benefits associated with each membership tier are presented at the time of enrollment and may be updated from time to time. Your membership entitles you only to the benefits associated with the plan you selected.

Access to classes, special sessions, and events may require advance registration and is subject to availability and capacity limits. We do not guarantee availability for any specific class or session.

We reserve the right to modify membership benefits, schedules, class offerings, and facility access as needed for operational, safety, or business reasons. Any changes will apply on a prospective basis.

Billing

Membership term and auto-renewal

Your membership begins on the date of enrollment and continues on a month-to-month basis unless properly canceled in accordance with this agreement.

Membership fees are billed on a recurring monthly basis using your payment method on file.

Prorated first month

If you enroll after the beginning of a billing cycle, your first month’s charge will be prorated based on the number of days remaining in that cycle. After the initial prorated period, your membership will be billed at the full monthly rate on your regular billing date.

Proration applies only to the initial billing cycle and to upgrades of membership tiers.

Payment methods and authorization

You agree to maintain a valid payment method on file at all times. Payments may be made by credit or debit card or by ACH draft from a designated bank account.

By providing your payment information, you authorize stomp and play llc to initiate recurring monthly charges for membership fees, applicable convenience fees, and any other charges incurred under this agreement. This authorization remains in effect until your membership is properly canceled.

Convenience fees

Payments made by credit or debit card will include a three percent (3%) convenience fee. Payments made by ach will include a one percent (1%) convenience fee. These fees are charged to cover processing costs and will be included in the total amount charged.

Billing and failed payments

Membership fees are billed monthly on the same day each month based on your enrollment date unless otherwise specified.

If a payment is declined, returned, or otherwise fails, your access to the facility may be suspended until the balance is paid. We may reattempt the charge and will assess a returned payment fee. Continued failed payments will result in termination of membership and collection of any outstanding balance.

No refunds

All membership fees are non-refundable. Failure to use the membership does not relieve your obligation to make payments.

Cancellation and Transferability

Cancellation policy

Membership cancellation requires advance notice. To avoid being charged for the following month, you must submit your cancellation request at least fifteen (15) days prior to the end of your current billing cycle.

If proper notice is not received, your membership will continue for an additional billing cycle and you will be charged the full monthly amount for that period.

All cancellation requests must be submitted online via your account. Requests made in person, email, phone, or through employees will not be accepted or processed. Employees are not responsible for cancellations or terminations of membership.

Your membership will remain active, and billing will continue, until a valid cancellation request is received and processed in accordance with this agreement.

Non-transferable membership

Memberships are issued to specific individuals and may not be shared, transferred, or resold. Misuse of a membership may result in suspension or termination without refund.

Policies and Requirements

Guest (bring-a-friend) policy

Certain membership tiers may include guest privileges. Guest access is limited to one guest per visit and is valid for standard open play only.

Guest passes may not be used for classes, special events, private parties, or summer camps. Guest passes may not be combined or stacked for a single visit.

Guests must be accompanied by the active member at all times and must have a valid, signed waiver on file prior to participation.

We reserve the right to limit or deny guest access due to capacity, safety concerns, or misuse of the program.

Facility rules and supervision

You agree to follow all posted rules and instructions from staff. Parents/guardians/responsible parties are responsible for supervising applicable minors at all times and for ensuring safe and respectful behavior.

You are responsible for any damage caused beyond normal wear and tear.

Closures and availability

From time to time, the facility may be closed for private events, maintenance, holidays, or other operational needs. Membership does not guarantee access at all times.

Membership does not include private parties, camps, or special camps or other events unless specifically stated.

Changes to membership

We may update or modify membership pricing, benefits, hours, or terms at any time. Changes will apply to future billing periods.

Waiver requirement

A signed liability waiver is required for all participants. Membership does not replace or waive this requirement.

Assumption of risk and indemnification

You understand that participation in activities involves inherent risks. By participating, you voluntarily assume those risks.

You agree to indemnify and hold harmless Stomp and Play LLC from any claims arising from participation, conduct, or use of the facility.

Governing law

This agreement is governed by the laws of the state of Texas. Any disputes shall be settled via bench trial in the county where the facility operates.

Severability

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Acknowledgment

By enrolling in a membership, you confirm that you have read, understand, and agree to this agreement.
